Can my employer fire me for getting hurt on the job?

Under Section 132a of the California Workers’ Compensation Code, it is illegal for an employer to fire or threaten to fire an employee because of a work-related injury or if that employee files or plans to file a workers’ comp claim. This means that your employer cannot retaliate against you for filing a workers’ compensation claim.

However, your employer may fire you for any other reason and that reason cannot be related to your filing of a workers’ compensation claim. If this is the case, your employer must be able to show that they had other reasons for firing you that were unrelated to the filing of your workers’ compensation claim.
